Due process is not a technicality. It is a constitutional protection that matters most when a person’s freedom is at stake. A father of two young children had been released from immigration custody and was complying with the terms of his release in Washington, DC. Then, as a passenger on his way to work, he was abruptly taken back into custody without a warrant and transferred to another state. Chapman partnered with the Amica Center for Immigrant Rights to help. We filed a petition in federal court in Texas, arguing that his detention violated his Fifth Amendment right to due process. The court agreed, ruling that the detention was unlawful and ordering our client released under conditions no more restrictive than those in place before he was detained.
This is the third due process case Chapman has won in partnership with the Amica Center. Each case is a powerful reminder that due process is not an abstract principle; it is a safeguard with real consequences.
